The Federal Minister for the Environment declared that under the Environment Protection Biodiversity and Conservation Act (EPBC Act), the proposal was not a controlled action.

The EGSC obtained State and Federal funding to prepare the EES. They also sought a community contribution to the EES process of $30,000 to be raised by supporters of the development. To date this money has not been raised from the community, yet the EGSC has continued to prepare the EES.
The EES was finally completed & approved for exhibition mid 2007.
